I. Conditions of sale
The online store, hereinafter referred to as daxiwine.com (referring to the domains daxiwine.cy, daxiwein.ch and daxiwein.at) is the exclusive property of the company WORKPRO LTD., VAT No. 10396156Z – Georgiou Griva Digeni 109, 3101 Limassol. Tel:+357.96.699005.
Management of the service/sale is the responsibility of WORKPRO LTD.
By placing an order, the customer declares their agreement with these Conditions of sale.
The customer’s order constitutes a binding offer. Acceptance of the customer’s offer by DaxiWine occurs through the factual delivery of the ordered goods. DaxiWine is entitled to reject an order even without stating reasons.
II. Online dispute resolution
Pursuant to European Union Regulation no. 524/2013, European Customers should be aware that the European Commission has set up an online platform that acts an alternative dispute resolution tool.
This tool can be used by any European Customer for out of court settlement of any dispute relating to contracts for the sale of goods and services entered into online and/or arising from the same. Consequently, if you are a Customer resident in Europe, you may use this platform to resolve any disputes arising from the online contract entered into on this website.
III. Terms
THE SALE OF ALCOHOLIC PRODUCTS TO MINORS IS PROHIBITED.
- Users of the daxiwine.com website confirm that they are of legal age under the legislation applicable to them. If there is no legislation in this regard, you must be at least 18 years old,
- All retail prices include VAT and do not include any taxes, duties and levies that may be imposed in the destination country of the products and/or services if this is not Cyprus. These costs vary from country to country and are the responsibility of the customer, who must check the amount with the relevant customs authorities,
- All shipments are insured,
- The Site is updated several times a day,
- The shipment will always be documented with a separate invoice and, unless otherwise specified by the customer, will be made available online on the customer’s personal order page (“My Orders”),
- The cost of each shipment must be added to the price of the individual product and/or service, the shipping cost may vary depending on the delivery and payment method chosen, as well as on the destination country. The total amount due for the selected products and/or services shall be clearly indicated and provided to the Customer prior to the conclusion of the Contract of Sale,
- The prices shown on the site are subject to variation and/or change by daxiwine.com without any obligation to provide the Customer with prior notice. These changes may be due to increases imposed by DaxiWine suppliers, among others. The prices in effect at the time of receipt of the Order shall apply to Contracts of Sale entered into but still in progress prior to the publication of the aforementioned changes,
- Advertised product prices may vary depending on the vintage and size.

IV. Legal
All products are covered by a Legal Guarantee within two years of the date of delivery.
Legal protection does not apply to goods that have been used, damaged, or altered by the end user (the customer).
The customer may request that the vendor replace or repair the item for free, unless the requested replacement or repair is rendered impossible or the vendor charges excessive rates to perform such tasks.
The consumer has the right to a reasonable and fair reduction in the price of the defective product or the resolution of the sales contract. This is especially true if the vendor failed to perform the repair or replacement or if the vendor refused to make the goods fit for sale. Finally, if the defect in conformity is severe enough to warrant an immediate price reduction, the consumer has the right to a reasonable and fair price reduction.
If the nonconformity is the result of an error or there are only minor flaws, the consumer has no right to revoke the contract.
To be eligible for this Legal Guarantee, the customer must notify the vendor of the nonconformity in writing, describing and providing proof of the flaws and any other major issues with the product.
Unless otherwise proven, any conformity flaw that appears within six months of the purchase of the good is assumed to be pre-existing, unless such an assumption is incompatible with the nature of the benefit or the nature of the conformity flaw.
In the event of a dispute:
These General Conditions are subject to laws of Republic Cyprus as is each Contract of Sale and subject to Cyprus jurisdiction.
Any dispute relating to the Conditions of sale or to the Contracts of Sale shall be subject to the jurisdiction of Republic Cyprus.
V. Defective goods / Damaged shipments
In the event of defective goods:
- These may be returned to daxiwine.com within 14 days of delivery,
- The return shipping costs are payable by the consumer,
- Defective goods will be replaced or refunded (if out of stock) by DaxiWine.
In the event of a damaged shipment:
Should you receive a package from DaxiWine that has been visibly damaged by the courier (damaged packaging or visibly stained by wine leaking from broken bottles) you have the following options:
- You should not accept the delivery. The shipment will be returned to DaxiWine.
If the damaged product is out of stock, you will be contacted to arrange a replacement, if you cannot find a replacement product in our catalogue, DaxiWine will refund the amount paid.
DaxiWine is responsible for any shipping costs for returning the damaged package in case of refused acceptance of the delivery.
Non-compliant wine
Non-compliant wine means wine that differs from the producer’s quality standards. This includes, but is not limited to, the distinctive “corked” smell and taste, rather than leaking liquid or a label that has been ruined in transit.
Non-compliant wine can be replaced, provided it is still available, at no extra cost to the customer. If the wine is no longer available, the price paid will be refunded.
As soon as the customer notices an alleged non-compliance, he/she must report the alleged non-compliance of any bottles from any of the wineries by email to [email protected] within 24 months of purchase and no later than three days of discovering the defect. This report must be accompanied by the DaxiWine order number and the collection address, as well as a description of each individual bottle believed to be non-compliant and the quantity in question.
DaxiWine will then arrange for a courier to collect the product free of charge from the address provided in the email.
The product or products must be returned with at least 2/3 of the original contents and sealed with the original cork suitably trimmed. The return package must be handed to the courier in its original packaging to protect the wine in transit. This procedure must be followed for DaxiWine to be reimbursed by the producer or its representative.
Once the wine has been returned and its non-compliance checked, a new shipment of bottles of the same type and vintage will be arranged immediately, if available, otherwise the price paid will be refunded immediately.
The procedure we follow uses as little paperwork as possible for the relevant checks and is completely free of charge to the customer.
In the event of a dispute, the bottles will remain available at DaxiWine for any further action by the relevant authorities and the customer will be charged for the cost of the courier collection.
Right of withdrawal for consumers
Purchases on the daxiwine.com website are subject to the Consumer rights in Republic of Cyprus, which guarantee you the right to withdraw from the purchase agreement.
You have the right to withdraw from the contract, without providing any reason, within 14 days. The withdrawal period expires 14 days after the day on which you or a third party other than the carrier and nominated by you take physical possession of the goods.
Procedure
In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract in an unambiguous statement, sent by e-mail to [email protected].
In order to comply with the withdrawal period, you just need to send the notification that you wish to exercise your right of withdrawal before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, you will be refunded all payments you have made to us, excluding delivery costs, without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Refunds may be issued after the 14 day period only as long as you have proved that you have returned the goods or until they are received by us, whichever is sooner.
Such refunds will be made to the same payment method that you used for the initial transaction, you will not incur any costs as a result of such a refund. The refund may be withheld until receipt of the goods or until you have proved that you have returned the goods, whichever is the earlier.
You are only liable for any reduction in the value of the goods resulting from any handling of the goods other than that necessary to establish the nature, characteristics and proper performance of the goods.
Please return the goods or surrender them to us without undue delay and in any event within 14 days from the day you notify us of your withdrawal from this contract. The deadline is deemed to have been met if you return the goods before the 14 day period has expired.
You are responsible for the direct costs of returning the goods.
The purchased goods must be fundamentally intact; we recommend that you take extra care when repackaging the goods, for example by using the original packaging.
Withdrawal exemptions
The following cases are exempt from the right of withdrawal:
The supply of goods made to measure or clearly personalised,
The supply of sealed goods that are not suitable for return for hygiene or health reasons and have been opened after delivery,
The supply of goods which are by their nature inseparably mixed with other goods after delivery,
The supply of alcoholic beverages, the price of which has been agreed at the time the sales contract is entered into, the delivery of which can only take place after thirty days and the actual value of which depends on fluctuations in the market that are beyond the control of the trader.
